By accessing or using Nuvinoo's services, including our wellness wearable device and companion app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users of our services, including parents, guardians, and any other individuals who access or use the Nuvinoo platform on behalf of a child.

2. Description of Service

Nuvinoo provides a wellness wearable device specifically designed for children, along with a companion mobile application that allows parents and guardians to monitor their child's:

  • Sleep patterns and quality
  • Physical activity and movement
  • General wellbeing indicators

3. Medical Disclaimer — Important Notice

PLEASE READ THIS SECTION CAREFULLY. BY USING NUVINOO, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

3.1 Not a Medical Device

Nuvinoo is a general wellness product and is NOT a medical device. The Nuvinoo wearable and companion application have not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA), Health Canada, the European Medicines Agency (EMA), or any other regulatory body as a medical device.

3.2 Not Intended for Medical Use

Nuvinoo is NOT intended to diagnose, treat, cure, mitigate, or prevent any disease, medical condition, or health problem. The information provided by Nuvinoo, including but not limited to sleep data, activity metrics, and wellness insights, is for general informational and educational purposes only.

3.3 Not a Substitute for Professional Medical Advice

The data, insights, alerts, and recommendations provided by Nuvinoo are NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your child's pediatrician or other qualified healthcare provider with any questions you may have regarding your child's health or a medical condition.

Never disregard professional medical advice or delay seeking it because of information provided by Nuvinoo.

3.4 Not for Medical Emergencies

Nuvinoo is NOT designed or intended for use in medical emergencies. If you believe your child is experiencing a medical emergency, call your local emergency services immediately (such as 911 in the United States) or take your child to the nearest emergency room. Do not rely on Nuvinoo to detect or alert you to medical emergencies.

3.5 Data Accuracy Limitations

While we strive to provide accurate data, the measurements and insights provided by Nuvinoo may not be accurate in all circumstances. Factors such as device placement, movement, environmental conditions, and individual physiological differences may affect data accuracy. The data should not be used as the sole basis for making health-related decisions for your child.

3.6 Consult Healthcare Providers

If you have any concerns about your child's sleep, activity levels, development, behavior, or overall health, please consult with a qualified healthcare professional. Nuvinoo is designed to supplement — not replace — your relationship with your child's healthcare providers.

3.7 No Guarantees of Health Outcomes

Nuvinoo makes no guarantees, representations, or warranties regarding health outcomes from using our product. Individual results may vary, and no specific health benefits are promised or implied.

4. User Accounts

To use Nuvinoo, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that the information you provide is accurate and up-to-date
  • Notifying us immediately of any unauthorized use of your account

5. Children's Privacy

We take children's privacy seriously. By using our service, you confirm that you are the parent or legal guardian of the child whose data is being collected, or that you have obtained proper consent from the parent or legal guardian.

We comply with applicable laws regarding children's privacy, including COPPA (Children's Online Privacy Protection Act) in the United States and similar regulations in other jurisdictions.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or networks

All content, features, and functionality of Nuvinoo, including but not limited to text, graphics, logos, icons, images, software, and the design of the wearable device, are the exclusive property of Nuvinoo and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

Nuvinoo is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The service will be uninterrupted or error-free
  • The data collected will be 100% accurate at all times
  • The service will meet your specific requirements

9. Limitation of Liability

To the fullest extent permitted by law, Nuvinoo shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes by posting the new terms on our website and updating the "Last updated" date. Your continued use of the service after such changes constitutes acceptance of the new terms.
